Is a risk analysis required under HIPAA?

Yes. The Security Rule at 45 CFR §164.308(a)(1)(ii)(A) requires covered entities to conduct an accurate and thorough assessment of the potential risks and vulnerabilities to the confidentiality, integrity, and availability of ePHI. The risk analysis must be documented and updated regularly or when operations change.

What is the difference between a risk analysis and a risk management plan?

The risk analysis identifies what risks exist and how severe they are. The risk management plan — supported by tools like this tracker — documents how the clinic is responding to those risks: what action is being taken, by whom, and by when. Both are required under 45 CFR §164.308(a)(1). OCR expects to see both in an investigation.

How often should the risk remediation tracker be updated?

Update the tracker whenever remediation actions are completed, when new findings are identified, or when the status of an existing item changes. A formal review of the full tracker should happen at least annually and any time a significant operational change occurs — new systems, new vendors, new physical locations.

What does 'Accepted Risk' mean as a status?

Accepted Risk means the clinic has reviewed the finding, determined that the cost or feasibility of remediation outweighs the residual risk, and has documented that decision. It is not a way to ignore findings — it requires a documented rationale signed by an accountable person. OCR expects accepted risk decisions to be explicit and reasoned, not simply left open.
