Is a HIPAA release form the same as an authorization form?

In most clinical contexts, yes — both refer to the written patient authorization required under 45 CFR §164.508 for releasing records. 'Release form,' 'ROI form,' and 'authorization form' are common names for the same legal instrument. However, the term 'authorization form' is also used for a narrower category of disclosures where HIPAA always requires explicit consent regardless of other permissions — specifically psychotherapy notes, marketing, sale of PHI, and research uses. Can a patient revoke a release authorization?

Yes. Patients have the right to revoke an authorization in writing at any time, except to the extent that the covered entity has already acted in reliance on it. Your form must include a statement explaining this right.

Does every records request need a signed authorization?

No. Treatment, payment, and healthcare operations disclosures generally do not require a signed authorization. Releases to the patient themselves, or to parties the patient designates, do. A mandatory authorization is also required for most marketing and sale-of-PHI disclosures.

How long must you retain a signed authorization?

Six years from the date of creation or the date it was last in effect, whichever is later, per 45 CFR §164.530(j).
